Steve House recently won a Sixth District of Ohio Court of Appeals argument. This appeal arose from a trial that Mark Trimble conducted in April of 2024. The case involved a traumatic brain injury and the extent of said injuries. The jury returned a verdict which was exactly what Mark suggested. That was to award the Plaintiff $15,206.74 in medical bills and $15,000.00 for pain and suffering. This was a total verdict of $30,206.74. In Plaintiff’s closing argument, she requested $500,000.00 in damages. During negotiations, the Plaintiff was offered $50,000.00 for a settlement, but there was authority to $77,000.00. The Plaintiff would not settle the case for “anything less than $300,000.00”!
Mark tried the case with his patent style of not using an IME. The Plaintiff appealed the verdict because she claimed that there was no evidence that contradicted her experts’ testimony. The Court of Appeals determined, as the jury did, that the cross-examination of the Plaintiff’s experts clearly was proper and allowed the jury to reach the verdict it did. The experts were significantly impeached, and their opinions were contrary to several of the Plaintiff’s medical records that were introduced as evidence. Further, that the Plaintiff was significantly impeached.
Steve prepared the Brief for the Court of Appeals in which the Court cited to multiple cases in its Decision that Steve cited in the Brief. Also, Steve brought forth the contradictory evidence which devastated the Plaintiff’s case.
